GENERAL CONDITIONS FOR CONSUMERS
GENERAL PROVISIONS
The e-commerce website of Tiseco bvba with registered office at Industriezone Huttegem 2, 8570 Anzegem with VAT number BE0455 529 123 (hereinafter 'Tiseco') offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions ("Terms") apply to any order placed with Tiseco by a consumer, whether or not by a visitor to the e-commerce website (“Customer”). When placing an order, both physically and via the Tiseco webshop, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by Tiseco.
PRICE
All stated prices are expressed in EURO and are always VAT included , all other duties or taxes that are obligatory to be borne by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The indication of price only refers to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
OFFER
Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding for Tiseco. Regarding the correctness and completeness of the information provided, Tiseco is only bound by an obligation of means. Tiseco is under no circumstances liable or held liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is always valid while stocks last and can be adjusted or withdrawn by Tiseco at any time. Tiseco cannot be held liable for the unavailability of a product. If an offer has a limited validity or is made subject to conditions, this will be explicitly stated in the offer.

Next to the image of a product it is indicated whether or not a product is in stock.
HOW CAN I PAY?
When completing your order you can pay by bank transfer, Bancontact or iDEAL.
Tiseco is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.
DELIVERY AND PERFORMANCE OF THE AGREEMENT
WHEN AND HOW WILL MY ORDER BE SHIPPED?
Are all products from your order in stock? In that case, your order will usually be shipped the same day, provided you have ordered before 11:00 AM (Central European Time) (unless stated otherwise). We ship our orders with the most appropriate delivery service (Fedex).
On the day of sending you will receive a shipping confirmation by e-mail with a Track & Trace code with which you can follow the status online on the website of the delivery service. Please note: the shipment may not be tracked until later in the day.
WHAT ARE THE SHIPPING COSTS?
Any shipping costs are automatically displayed in the shopping cart.
CAN I ALSO ORDER FROM ABROAD?
We deliver to all countries in the European Union.
RETENTION OF TITLE
The delivered items remain the exclusive property of Tiseco until full payment has been made by the Customer, without this affecting the transfer of risk.
The Customer undertakes, if necessary, to inform third parties of Tiseco's retention of title, for example to anyone who would seize the articles not yet fully paid for.
The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from Tiseco.
If the right of withdrawal applies:
The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day:
for sales contracts (including contracts involving both goods and services): "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.";

The Customer can use the enclosed model withdrawal form for this, but is not obliged to do so.

To meet the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Tiseco - Huttegem 2 - 8570 Anzegem immediately, but in any case no later than 14 calendar days after the day on which he has notified Tiseco of his decision to withdraw from the agreement. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods will be borne by the Customer.
If the returned product is in any way diminished in value, Tiseco reserves the right to hold the Customer liable and claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.
If the Customer cancels the agreement, Tiseco will refund all payments received from the Customer up to that moment, including the standard delivery costs to have the good delivered to the customer with the first order, within a maximum of 14 calendar days after Tiseco on the has been informed of the Customer's decision to withdraw from the contract. In the case of sales agreements, Tiseco can wait with the refund until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.
Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Tiseco will not be reimbursed.
Tiseco will pay back the Customer with the same payment method with which the Customer made the original transaction, if this is possible.
The Customer cannot exercise the right of withdrawal for:
- Service contracts as soon as the execution has started;
- the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person;
- the delivery of goods that spoil quickly or with a limited shelf life;
- the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
- agreements in which the Customer has specifically requested Tiseco to visit him in order to carry out urgent repairs or maintenance there;
- the delivery of sealed audio and sealed video recordings and sealed computer software of which the seal has been broken after delivery;
- the supply of newspapers, magazines or magazines, with the exception of contracts for a subscription to such publications;
- the delivery of digital content that has not been delivered on a tangible medium, if the performance has started with the explicit prior consent of the Customer and if the Customer has acknowledged that he thereby loses his right of withdrawal (eg downloading music, software);
WARRANTY
Under the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This means that in case of defects or defects in the article up to 2 years after delivery, this article will be repaired or replaced free of charge. As far as possible and reasonable, you have a choice between repair or replacement. Only in the event that the repair or replacement is excessive, impossible or cannot be carried out within a reasonable period of time, do you have the right to demand a price reduction or the termination of the sales contract. If the defect or defect manifests itself within 6 months after delivery, it is considered to have already existed before delivery, unless we can prove the contrary. After 6 months, you will have to prove that the defect was already present at the time of delivery. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
- To invoke the warranty, the Customer must be able to present proof of purchase.
- In the event of a defect, the Customer must inform Tiseco as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been established. Afterwards, any right to repair or replacement lapses.
- The legal warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
- Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

UNSATISFIED?
Because we want to provide our customers with the best possible service, we think it is important to hear from you if you are not satisfied with our services. Do this - partly to limit any damage - as soon as possible. According to the law, a complaint is made known in time if this is done within two months of discovery. It is in your interest to make your complaints known in writing. If you submit a complaint to us, it will be answered by e-mail within 14 days at the latest. If we need more time for this, we will let you know within 14 days when you can expect an answer. Complaints can be sent to: support@tiseco.be o.v.v. your customer number and the reason why you are not satisfied.
PENALTIES FOR NON-PAYMENT
Tiseco has the right not to deliver until payment has been made.
EXAMINATION OF VALIDITY - NON-RELIEF
If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Tiseco to enforce or exercise any of the rights listed in these Terms and Conditions will never be regarded as a waiver of such provision and will never affect the validity of these rights.
CHANGE OF TERMS
These Conditions are supplemented by other conditions to which explicit reference is made, and the general terms and conditions of sale of Tiseco. In the event of a conflict, these Terms and Conditions will prevail.
PROOF
The Customer accepts that electronic communications and backups can serve as evidence.
APPLICABLE LAW - DISPUTES
Belgian law is applicable, with the exception of the provisions of private international law regarding applicable law.
In the event of a physical sale, the courts of the registered office of Tiseco are competent in legal disputes. In the case of online sales, the courts of the Consumer's place of residence are competent in legal disputes. The Consumer can also turn to the ODR platform http://ec.europa.eu/consumers/odr/.
